Trade conflicts with China increase in number
According to the KCAB (The Korean Commercial Arbitration Board), trade disputes lodged against Chinese companies numbered 79 cases from 1998 to 2001. Pricing was the largest source of conflict, accounting for 32 of the 79 cases or 40.5%
After price came loading default with 16 cases (20.3%), inferior goods with 15 cases (18.9%), and the remaining 16 cases (20.3%) being due to different issues.
By item, the most disputed item numbered 27 cases (34.2%), textiles accounted for 10 cases (12.7%), electronics 6 cases (7.6%), while the remaining 36 cases (45.5%) were spread across a wide variety of goods.
By contract type, sales and joint venture cases were responsible for the lions share at 71 of the 79 cases, or 89.8%. Agent disputes numbered 4 (5.1%), while the processing industry had 3 cases (3.8%) and transportation one case (1.3%).
"Including the case handled as a suit and the case handled through a foreign arbitration organization, disputes will increase much more… as trade with China is expanding since China's joining the WTO last year, trade disputes will continue to increase," said KOTRA.
The KCAB heard 21 disputes against Chinese companies this year, an increase of 50 percent over last year.
